An invention is ready to share. Is it ready to disclose?

What to organise before a demo, publication or conversation about your technical idea.

Start with the technical problem

Describe the problem, the current approaches and what your solution changes. Patents concern inventions; eligibility depends on the applicable law, including novelty, inventive step and industrial applicability. A promising concept is not, by itself, proof of patentability.

Think about disclosure before the launch

Publishing technical details before filing can affect novelty. Rules and exceptions vary, so do not assume a grace period will rescue a public demo. If you have already disclosed something, record what was shared, with whom, on which date and under what conditions, and obtain advice promptly.

Organise the invention record

Create a working folder with dated drawings, prototypes, test results, contributors and earlier technical references. Separate what is essential to the invention from optional features. This is a preparation exercise, not a substitute for drafting a patent specification.

An example: a water-saving mechanism

Imagine an engineering team building a new valve. Their pitch deck can explain the customer problem without revealing every mechanism. Before a public technical demonstration, the team should discuss filing and confidentiality with an appropriate professional. The brand name, product appearance and technical mechanism may need different kinds of IP consideration.

Understand the path ahead

A patent process can involve searching, drafting, filing, publication, examination, responses and a grant decision. Filing does not guarantee a grant, and a patent does not automatically establish freedom to operate. Ask separately about patentability, commercial use risks and the countries in which protection would be useful.
